In consideration of being allowed participating in the Daytona Brazilian Jiu-Jitsu Open sporting events and activities, the undersigned:
- Agree that prior to participating, they will inspect the facilities and equipment to be used, and if they believe anything is unsafe, they will immediately advise their coach of such conditions and refuse to participate.
- Acknowledge and fully understand that each participant will be engaging in activities that involve the risk of serious injury, including permanent disability and death, and severe economic and social losses which might result not only from their own actions or negligence, but also from actions or negligence of others, the rules of play or the conditions of the premises or any equipment used. Further, that there may be other risks not known to us and not reasonably foreseeable at this time.
- Assume all foregoing risks and accept personal responsibility for the damages following such injury, permanent disability or death.
- Release, waive, discharge and covenant not to sue Daytona BJJ Open, its affiliated clubs, their respected administrators, directors, agents, coaches and other employees of the organization, other participants, sponsoring agents, sponsors, advertisers and if applicable, owners or leasers in the premises used to conduct the event, all of which are hereinafter referred as the lessees, from ant and all each the undersigned, his or her heirs for the next of kin for any and all claims, demands, losses, or damages on account of injury, including death or damage of property, caused or alleged to be caused in whole or in part by in the negligence of the releasees or otherwise.
- For minors: agree the parent(s) or legal guardian(s) will instruct the minor participant in that prior to participating he or she should inspect the facilities and equipment to be used, and if the participant believes anything is unsafe, he or she should immediately advise his or her coach and refuse to participate.
- This wavier should not be modified in any way. If in any part this waiver is determined to be invalid by law, all other parts of the waiver shall remain valid and enforceable.
